  • Harmful Code: Uploading, transmitting, or distributing any virus, malware, Trojan horse, spyware, ransomware, or any other harmful, disruptive, or destructive code or file.
  • Data Scraping: Using automated bots, scrapers, crawlers, or other automated tools to extract data from the Site without our express written permission.
  • Interference: Engaging in any activity that interferes with or disrupts the Site, its servers, or the networks connected to the Site.

5. Payment Terms and Online Orders

5.1 Pricing and Payment

All prices listed on the Site or in our online ordering system are in United States Dollars (USD) and are subject to change without prior notice. Applicable sales taxes will be calculated and added to your order total at checkout based on the location of the restaurant or delivery address and applicable state and local tax laws.

We accept major credit cards, debit cards, and other payment methods as indicated at the time of checkout. By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our payment processing partners) to charge your payment method for the total amount of your order, including taxes and any applicable fees.

5.2 Order Accuracy and Confirmation

It is your responsibility to review your order carefully before submission. Once an order is placed and confirmed, modifications may not be possible depending on the stage of preparation. We are not responsible for orders that are incorrect due to customer error.

Order confirmation does not guarantee availability. In the event an item is unavailable after your order is placed, we will make commercially reasonable efforts to contact you and offer an appropriate substitute or refund for that item.

5.3 Cancellations and Refunds

Cancellation and refund requests are handled on a case-by-case basis. Because our products are perishable food items prepared fresh upon order, we generally do not accept cancellations once food preparation has begun. We will review your claim and, at our discretion, may offer a replacement, store credit, or refund.

5.4 Third-Party Delivery Platforms

If you place an order through a third-party delivery platform (such as DoorDash, Grubhub, Uber Eats, or similar services), such orders are governed by the terms of service of those respective platforms. Anthony's Coal Fired Pizza is not responsible for issues arising from third-party delivery services, including but not limited to delivery delays, incorrect orders, or payment disputes processed through those platforms.


6. Disclaimers and "As-Is" Basis

To the fullest extent permitted by applicable law, Anthony's Coal Fired Pizza expressly disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • Any warranty that the Site will be uninterrupted, timely, secure, or error-free;
  • Any warranty regarding the accuracy, reliability, completeness, or currency of any content or information on the Site;
  • Any warranty that defects in the Site will be corrected; and
  • Any warranty regarding the results that may be obtained from using the Site or Services.

7. Limitation of Liability

IN NO EVENT SHALL ANTHONY'S COAL FIRED PIZZA, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue;
  • Loss of data or information;
  • Business interruption;
  • Personal injury or property damage;
  • Costs of substitute services; or
  • Any other indirect or consequential losses,

EVEN IF ANTHONY'S COAL FIRED PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, ANTHONY'S COAL FIRED PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE AND SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO ANTHONY'S COAL FIRED PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, Anthony's Coal Fired Pizza's liability shall be limited to the maximum extent permitted by applicable law.

Nothing in these Terms shall limit or exclude our liability for fraud, willful misconduct, death, or personal injury caused by our negligence to the extent that applicable law prohibits such limitation or exclusion.


8. Indemnification

You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza, its owners, officers, directors, employees, agents, licensors, contractors, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in any way connected with:

  • Your access to or use of the Site or Services;
  • Your violation of these Terms or any applicable law or regulation;
  • Your violation of any rights of a third party, including intellectual property rights, privacy rights, or consumer rights;
  • Any fraudulent, false, or misleading information provided by you;

Anthony's Coal Fired Pizza reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate fully with Anthony's Coal Fired Pizza in asserting any available defenses. You shall not settle any such claim without our prior written consent.


9. Governing Law and Jurisdiction

These Terms of Service and any disputes or claims arising out of or in connection with them, their subject matter, or formation (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Anthony's Coal Fired Pizza operates, without regard to its conflict of law principles.

These Terms are further subject to all applicable federal laws, including but not limited to:

  • The Federal Trade Commission Act (15 U.S.C. § 41 et seq.) governing unfair or deceptive acts and practices in commerce;
  • The Electronic Communications Privacy Act (18 U.S.C. § 2510 et seq.);
  • The Computer Fraud and Abuse Act (18 U.S.C. § 1030);
  • The CAN-SPAM Act (15 U.S.C. § 7701 et seq.) for electronic communications; and
  • Any other applicable federal consumer protection statutes.

Subject to the dispute resolution provisions set forth in Section 10 below, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the United States for the resolution of any disputes not subject to arbitration. You hereby waive any objections to the exercise of jurisdiction over you by such courts and to venue in such courts.


10. Dispute Resolution

10.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact Anthony's Coal Fired Pizza at [email protected] and provide a written description of the dispute, the relief sought, and your contact information. The parties agree to use good faith efforts to resolve the dispute informally for a period of thirty (30) days from the date of the written notice. If the dispute is not resolved within this period, either party may proceed to binding arbitration as described below.

10.2 Binding Arbitration

To the extent permitted by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, invalidity, breach, or termination thereof, shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

The arbitration shall be conducted in the English language. The seat of arbitration shall be in the United States. The arbitrator shall apply the substantive law of the United States and the applicable state law as provided in Section 9.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights. Such legal action shall not be deemed a waiver of the obligation to arbitrate other claims.


11. Term and Termination

These Terms shall remain in full force and effect for as long as you access or use the Site or Services. Anthony's Coal Fired Pizza reserves the right, in its sole discretion and without notice or liability, to:

  • Terminate or suspend your access to all or any part of the Site and Services at any time, for any reason or no reason;
  • Delete your account and all associated information;
  • Restrict your ability to place orders, make reservations, or otherwise use our Services; and
  • Pursue any other available legal or equitable remedy.

16. Force Majeure

In the event of a Force Majeure Event, we will make commercially reasonable efforts to resume performance as soon as practicable and will notify you of the situation to the extent feasible. During a Force Majeure Event, our obligations under these Terms shall be suspended to the extent affected by such event.


17. Severability Clause

If any provision of these Terms of Service is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, unenforceable, or void under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, shall be severed from these Terms. The invalidity, illegality, or unenforceability of any such provision shall not affect the validity or enforceability of the remaining provisions of these Terms, which shall continue in full force and effect.

The parties agree that any invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the intent and economic effect of the original provision. The failure of either party to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
